The User will be responsible to see that the property is used by a licensed person as required by law, or if no license is required, that the operator is qualified to operate WSU property. The User will not permit said WSU property to be used by any other person or at any other address other than the location designated here-on without the express consent of WSU. User agrees to indemnify and save harmless the WSU organization against all loss, damage, expense, and penalty arizing from any action on account of any injury to persons or property of any character occasioned by the operation, handling, and transport of the WSU property while the property is in the possession of and control of the User. WSU shall not be liable for any claim by any third party and the User will indemnify and hold harmless therefrom. WSU shall not be liable in any event to the User for loss, delay or damage of any kind or character resulting from defects in or inefficiency of the WSU personal property or accidental breakage thereof. User is required to use and maintain in serviceable condition all safety attachments and gear as required by local, state and federal laws. In the event that the WSU property becomes unsafe, overheated or in a state of disrepair, the User will cease using it immediately, and will notify WSU of fact. WSU retains the right to recover the WSU property at any time if the User fails to comply with any terms or conditions of this agreement.
